A Transfer of Equity changes the legal ownership of a property. This could be either by adding someone onto the property or removing someone from the title.

A Transfer of Equity can be used in different types of situations and purposes, for example:

  • In marriage – one spouse may wish to make a transfer of equity in the family property to the other spouse
  • For re-mortgage purposes, to improve credit rating
  • Divorce or separation- one party may purchase the others share or it may be transferred as part of a court settlement
  • As a gift – parents often gift a share of the property or the entire property to their children

Our specialist Residential Conveyancing solicitors have considerable experience in dealing with all types of Deeds of Gifts or Transfer of Equity and will be happy to offer specialist support and advice at all stages of the transfer of equity process.

Please be reassured that we are particularly sensitive to the fact that in certain situations there are multiple parties involved in a transfer, such as outgoing parties, incoming parties and mortgage lenders. We have the experience to ensure that the Transfer of Equity process runs smoothly.

What Is Right To Buy?

You must meet the criteria below to be eligible for Right to Buy:

  • You are required to be a council tenant
  • The particular property must be the only home you are a resident of.
  • You must have resided in the property for more than three years
  • You must be free from any legal debt
  • You cannot have any outstanding possession orders against you
  • The property must not have an outstanding demolition order

The Application Process For Right To Buy

Often the starting point will be to complete a notice claiming a right to buy. You will also have to consider how the purchase will be funded and you may need to get a loan or mortgage to enable you to exercise the Right to Buy.

It is important to get the right legal advice from the outset so that you are aware what the implications of the purchase will be and Wildings Solicitors will be happy to advise you.

Some of the issues you will need to consider are your potential responsibilities for the costs of maintaining the property including routine repairs and major structural repairs and improvements. If you become a leaseholder by buying your flat, you should be aware that you will have to pay service charges each year, and also meet the costs of major repairs and refurbishment which can be substantial.

Once you have instructed Wildings we will ask for the paperwork from the council/housing association and peruse the documentation and report to you accordingly.
