A Child Arrangement Order is a legal instruction from the court, and it is not optional. If the other parent is not complying, the C79 form is the official legal step to ask a judge to intervene and enforce the terms of the order.

Drafting the C79 Application

We ensure the form is completed accurately, detailing precisely how the original order has been breached and what you are asking the court to do about it.

Questions About the C79 Application

What is the purpose of a C79 application?

A C79 application is used specifically to ask the court to enforce a Child Arrangement Order that you believe has been broken by the other party without a reasonable excuse.

What happens after the C79 form is submitted?

The court will issue (stamp) the application and ensure it is served on the other person (the Respondent). A hearing will then be listed where both parties must attend court to discuss the alleged breaches with a judge.

What can the court do if it agrees the order was breached?

The court has a range of powers, including varying the original order, ordering contact to make up for missed time, ordering the person in breach to attend parenting programmes or pay financial compensation. In very serious cases, the court can even impose a fine, community service, or a prison sentence.
