Common Questions About Civil Partnerships

What is the legal difference between a civil partnership and marriage?

Today, there are very few legal differences. Civil partners have the same rights as married couples regarding finances, property, pensions, and parental responsibility. The main differences are historical and procedural: civil partnerships are registered by signing a schedule, whereas marriages are solemnised with spoken vows.

How do you end a civil partnership?

The process is called 'dissolution', and it is almost identical to the 'no-fault' divorce process for married couples. It requires an application to the court to state that the partnership has irretrievably broken down, followed by a Conditional Order and then a Final Order.

Are our financial rights the same as a married couple if we separate?

Yes. Upon dissolution, civil partners have the same rights to make claims against each other's finances, property, and pensions as married couples do. It is vital to secure a legally binding Financial Consent Order to protect your future.
