What is the legal definition of adultery in the UK?

Legally, adultery is defined as voluntary sexual intercourse between a married person and someone of the opposite sex who is not their spouse. For this reason, a relationship with someone of the same sex is not legally defined as adultery, but could instead be used as an example of 'unreasonable behaviour'.

Do I still have to cite adultery in a 'no-fault' divorce?

No. Under the no-fault divorce system, you no longer need to give a reason or 'fact' such as adultery. You simply state that the marriage has irretrievably broken down. This has made the process much less confrontational. You can still choose to name adultery on the application, and we can advise you on the pros and cons of doing so.
