How Adultery Legally Affects a Divorce

It is a common myth that proving adultery will lead to a better financial settlement. With the introduction of 'No-Fault Divorce' in the UK, the court is no longer concerned with blame. Its focus is on achieving a fair and reasonable outcome for both parties.

What Adultery Does NOT Affect:

  • Financial Settlements: A judge will not punish a spouse financially for adultery. The division of assets is based on financial needs and contributions, not behaviour.
  • Child Arrangements: Adultery is generally not considered relevant to a parent's ability to care for a child, unless the new relationship poses a direct risk of harm to the child's welfare.

Where Adultery is Still Relevant

While adultery does not typically affect the financial outcome, it can still be a factor in your divorce strategy. We provide expert advice on:

  • Deciding whether to name the third party in the divorce application.
  • Understanding the strict legal definition of adultery.
  • Navigating the emotional challenges while focusing on a constructive divorce settlement.

Objective Advice for an Emotional Time

We understand the hurt and anger that adultery causes. Our role is to provide a calm, objective, and strategic perspective. We help you separate the emotional issues from the legal ones, ensuring you make clear decisions that protect your future, rather than acting in the heat of the moment.

  • Objective & Non-Judgmental: We provide a safe, confidential space to discuss your situation, whoever is at fault.
  • Strategic Focus: We redirect the focus away from blame and onto achieving a fair financial and child arrangement outcome.
  • Protecting Your Dignity: Our aim is to resolve your divorce as amicably as possible, avoiding unnecessary and costly court battles over blame.

Questions About Divorce and Adultery

What is the legal definition of adultery in the UK?

Legally, adultery is defined as voluntary sexual intercourse between a married person and someone of the opposite sex who is not their spouse. For this reason, a relationship with someone of the same sex is not legally defined as adultery, but could instead be used as an example of 'unreasonable behaviour'.

Do I still have to cite adultery in a 'no-fault' divorce?

No. Under the no-fault divorce system, you no longer need to give a reason or 'fact' such as adultery. You simply state that the marriage has irretrievably broken down. This has made the process much less confrontational. You can still choose to name adultery on the application, and we can advise you on the pros and cons of doing so.

Can adultery affect a financial 'Clean Break Order'?

No. The court's decision on whether a Clean Break Order is appropriate is based entirely on the financial circumstances of the case and ensuring both parties' future needs are met fairly. It is not used to punish behaviour during the marriage.
