Family Mediation

Family mediation is a process that helps separating or divorcing couples resolve disputes about children, finances, or property without going to court. A trained, independent mediator helps both parties communicate and reach an agreement in a fair and structured way. Before applying to Family Court for a Child Arrangement Order or a Financial Order, you must usually attend a Mediation Information and Assessment Meeting (MIAM). A MIAM is a first meeting to see if mediation is suitable.

When is Family Mediation Used?

Family mediation is commonly used for:

  • Child arrangements – Who the child lives with, how much time they spend with each parent, and how decisions about their upbringing are made.
  • Financial settlements – Division of property, savings, pensions, and financial support.
  • Divorce settlements – Agreements on financial and property matters before finalising a divorce.
  • Cohabitation disputes – Resolving issues between unmarried couples who separate.
  • Grandparents’ rights – Helping grandparents agree on access to their grandchildren.

How Does Family Mediation Work?

  1. Initial Meeting (MIAM) – Each party has a separate meeting with the mediator to explain their situation.
  2. Mediation Sessions – If both parties agree, joint sessions are arranged to discuss disputes.
  3. Reaching an Agreement – The mediator helps both sides agree on solutions.
  4. Memorandum of Understanding – If an agreement is reached, the mediator writes a non-legally binding document outlining the terms.
  5. Legal Finalisation – Agreements can be made legally binding through a Consent Order if both parties wish.

Benefits of Family Mediation

  • Faster than court – Mediation can resolve disputes in weeks or months, while court cases can take years.
  • Less expensive – It is usually cheaper than court proceedings.
  • Less stressful – Mediation is more amicable and avoids court confrontation.
  • More control – Parents decide arrangements, rather than a judge making the decision.
  • Confidential – Discussions in mediation remain private, unlike court proceedings.

Family mediation is a cost-effective and less stressful way to resolve family disputes without court involvement. It allows parents and couples to make mutual decisions in the best interests of their children and finances.
