What are the duties of a Financial Attorney or Deputy?

Your primary duty is to always act in the best interests of the person you are helping. This includes keeping their finances separate from your own, maintaining accurate accounts, and making prudent decisions about their money and property. As a Deputy, you are supervised by the Office of the Public Guardian (OPG) and must submit an annual report.

What if my parent has dementia and refuses to create an LPA?

This is a difficult but common scenario. If your parent still has mental capacity (understands the decision and its consequences), you cannot force them. However, if they have already lost capacity, it is too late for an LPA. In this case, your only option is to apply to the Court of Protection for a Deputyship Order. We strongly advise seeking legal advice immediately to assess the situation.

Can an LPA be used to change a Will?

No, absolutely not. An attorney or deputy has no authority to change the person's Will. Their role is to manage the person's assets for their benefit during their lifetime. The Will only takes effect upon death.
