Starting a Claim

What are the time limits for making a claim?

There are very strict time limits. For most claims, such as unfair dismissal, you must start the ACAS Early Conciliation process within **three months less one day** from the date your employment ended or the incident occurred. It is absolutely crucial to seek legal advice as soon as possible to protect your right to claim.

What is the ACAS Early Conciliation process?

Before you can lodge most claims at an Employment Tribunal, you must contact ACAS (Advisory, Conciliation and Arbitration Service). They will offer a free 'Early Conciliation' service to try and help you and your employer reach a settlement without the need for a formal tribunal claim. We can represent you throughout this process.

What evidence do I need for my claim?

Evidence is key. This could include your contract of employment, emails, letters, text messages, and a timeline of events. Don't worry if you don't have everything; our role as your solicitor is to advise on what evidence is needed and how to present it effectively for your case.

Do I have to go to an Employment Tribunal?

It's unlikely. The vast majority of employment disputes are resolved without a final hearing. We are skilled negotiators and focus on achieving a positive outcome for you through methods like ACAS conciliation or a favourable settlement agreement, avoiding the stress and cost of a tribunal.

What is a Settlement Agreement?

A Settlement Agreement is a binding contract where you agree to waive your right to bring a claim in return for a severance payment. You must receive independent legal advice for it to be valid, a service our solicitors provide. Often, the employer will pay for this advice.

How are legal fees paid?

We offer clear, transparent fee structures. For Settlement Agreements, your employer usually covers the cost of your legal advice. For other claims, we will discuss all funding options with you at the outset. Please note, we do not offer 'No Win No Fee' agreements, which ensures the advice we give is always impartial and focused on your best interests.

How much compensation could I get?

The value of a claim depends on many factors, including your salary, length of service, and the specifics of your case. For unfair dismissal, for example, it is made up of a 'basic' award and a 'compensatory' award up to a statutory cap. We can give you an honest assessment of your potential claim value during our initial consultation.

What is a protected conversation?

This is a confidential discussion between you and your employer about ending your employment on agreed terms, usually with a settlement agreement. It allows for open, off-the-record negotiations. We can advise you on how to handle these conversations and what to expect.
