What is a Settlement Agreement?

A Settlement Agreement is a legally binding contract that is often used to end an employment relationship on agreed terms. In exchange for a sum of money, you agree to waive your right to bring future claims against your employer. You must receive independent legal advice from a solicitor for the agreement to be valid.

What counts as Unfair Dismissal?

To claim for unfair dismissal, you generally need to have been employed for at least two years. Your dismissal must be for a reason that is not fair (e.g. your role is not genuinely redundant) or because your employer followed an unfair procedure. Some reasons, like dismissal for being pregnant or for whistleblowing, are automatically unfair and do not require two years of service.

How long do I have to bring an Employment Tribunal claim?

There are very strict and short time limits for Employment Tribunal claims. In most cases, you must start the process by contacting ACAS for 'Early Conciliation' within **three months less one day** from the date of the incident (e.g., the date your employment ended). It is absolutely crucial to seek legal advice as soon as possible.
