Child Maintenance: When You Need a Solicitor

For most families, child maintenance is calculated by the government's Child Maintenance Service (CMS). However, a specialist solicitor is vital for ensuring fairness in complex situations and for making your agreement legally binding.

High Income Earners

The CMS formula only applies to gross weekly incomes up to £3,000. For incomes above this threshold, you will need a solicitor to apply to the court for a 'top-up' order to ensure a fair level of support.

School Fees & Extra Costs

Standard child maintenance does not cover private school fees or costs for disabilities. A solicitor is required to negotiate and formalise these extra payments in a court order.

Making an Agreement Legally Binding

If you reach a private agreement, it is not legally enforceable. We can draft your agreement into a Consent Order, giving you the power to enforce it if payments are missed.

Common Questions About Child Maintenance

How is child maintenance calculated in the UK?

The Child Maintenance Service (CMS) uses a set formula based on the paying parent's gross annual income, the number of children they have, and how many nights the children stay with them on average. We can provide you with an estimate of what you should pay or receive.

How long does child maintenance have to be paid?

Child maintenance is typically paid until a child turns 16, or until they turn 20 if they are in full-time, non-advanced education (such as A-Levels or equivalent). It does not cover university education.

What happens if the paying parent's income changes?

If there is a significant change in the paying parent's income (usually 25% or more), either parent can apply to the CMS for a recalculation. If your agreement is part of a court order, you would need a solicitor to apply to the court to vary the order.
