Why a Clean Break Order is Essential After Divorce

Without a court-sealed Clean Break Order, your ex-spouse's financial claims remain open indefinitely. This means they could potentially claim against your future earnings, pension, or even an inheritance, many years after your divorce is finalised. A Clean Break Order is the only way to achieve true financial separation.

The Risks of Not Having a Clean Break:

  • Your ex-spouse could claim against a future pay rise or bonus.
  • They may have a claim on your pension when you retire.
  • An inheritance you receive years later could be at risk.
  • It creates uncertainty and prevents you from moving on financially.

Questions About Clean Break Orders

Do I need a Clean Break Order if we have no assets?

Yes, it is highly recommended. A Clean Break Order protects your *future* assets. Without one, your ex-spouse could make a claim against you if you get a new job, receive an inheritance, or win the lottery years after your divorce is final.

When can I get a Clean Break Order?

You can start negotiating your clean break at any time. The final order can be submitted to the court for approval once you have received your Conditional Order (the middle stage of your divorce). It becomes legally binding upon your Final Order (the old Decree Absolute).

What if my ex-partner won't agree to a clean break?

If an agreement isn't possible, we would need to apply to the court for a contested Financial Order. The court will then decide what is fair. In most cases, a judge will aim to impose a clean break if it is fair to both parties.
