The Purpose of Cross-Examination in Family Court

Cross-examination has two key functions: to present your evidence in the most compelling way, and to challenge the evidence of the other party. Our solicitors are experts at both, ensuring your case is strong on all fronts.

Presenting Your Case

  • Preparing You to Give Evidence: We meticulously prepare you for giving evidence, ensuring you know what to expect and can present your testimony calmly and credibly.
  • Building Your Narrative: We use your witness statement and evidence to build a clear, powerful narrative for the judge.
  • Responding to Questions: We ensure you are prepared to answer questions from the other side in a way that strengthens your case.

Challenging the Other Side's Case

  • Testing Their Evidence: We will robustly and skilfully question the other party to test the accuracy and credibility of their statement.
  • Exposing Inconsistencies: Our focused questioning is designed to highlight any weaknesses or inconsistencies in the other side's case.
  • Challenging Allegations: This is a crucial part of a Fact-Finding Hearing where we can challenge unfounded allegations.

Questions About Cross-Examination

Will I have to give evidence and be cross-examined?

If your case proceeds to a final or fact-finding hearing, it is almost certain that you will need to give evidence from the witness box. This will involve you being questioned by the other side's solicitor or barrister (cross-examination). It is a daunting prospect, but our job is to prepare you thoroughly for it.

How will you prepare me for being cross-examined?

We will have detailed conferences with you to go through your witness statement and all the evidence. We will discuss the likely questions you will be asked and help you practice answering them in a clear, factual, and calm manner. Our goal is to ensure you feel as confident and prepared as possible.

I am scared of facing my ex-partner in court. What can be done?

The court is very aware of this issue, especially in cases involving domestic abuse. We can apply for 'special measures' to help you give your best evidence. This can include having a screen put up in the courtroom so you do not have to see the other person, or giving evidence via a live video link from a separate room.
