Questions About Fact-Finding Hearings

What is the 'burden of proof' in a Fact-Finding Hearing?

The burden of proof is on the person making the allegation. They must prove that it is "more likely than not" that the alleged incident(s) occurred. This is a lower standard than in criminal court ("beyond a reasonable doubt"), but still requires credible evidence.

Will I have to give evidence in person?

Yes. A Fact-Finding Hearing is a formal court hearing where both parties will be required to give evidence under oath and be cross-examined on the contents of their statements and the Scott Schedule. It is a daunting process, and our role is to prepare you for it and support you throughout.

What happens after the judge makes their "findings"?
