Questions About Emergency Hearings

What counts as an "emergency" for the Family Court?

An emergency is a situation where a child or adult is at risk of immediate and significant harm. This includes domestic abuse, risk of child abduction (being taken out of the country), or any other situation where waiting for a standard hearing would be dangerous.

What is a "without notice" hearing?

This is an emergency hearing that takes place without the other party (the Respondent) being notified. It is only granted in exceptional circumstances where alerting the other person could lead them to take the very action you are trying to prevent, such as absconding with a child.

What happens after an emergency order is made?

An order made at an emergency "without notice" hearing is temporary. The court will immediately schedule a second hearing, usually within a few days, where the other party is served with the papers and has the right to attend and respond to the order.
