The Key Stages of the Divorce Process

The divorce process in the UK has a minimum legal timeframe. The biggest factor that affects how long it actually takes is how quickly you and your ex-partner can agree on the arrangements for your finances and children.

The Divorce Application

One or both of you submit the divorce application to the court. This starts a mandatory 20-week 'cooling off' or reflection period.

Financial Disclosure

During the reflection period, we work with you to gather all necessary financial information and begin negotiations for your financial settlement.

Conditional Order

After 20 weeks, you can apply for the Conditional Order (previously the Decree Nisi). Once granted, you are legally separating.

Finalising Finances

Once the Conditional Order is granted, we can submit your agreed Financial Consent Order to the court to be made legally binding.

The Final Order

After your financial order is sealed by the court, you can apply for the Final Order (previously Decree Absolute) which legally dissolves the marriage.

Questions About the Divorce Timeline

What is the minimum time it takes to get a divorce?

The absolute minimum legal timeframe is 26 weeks (6 months). This is made up of the mandatory 20-week reflection period after the application is issued, followed by a 6-week period between the Conditional Order and when you can apply for the Final Order.

Why do some divorces take over a year?

The most common reason for delay is a failure to agree on the financial settlement. If you cannot agree and have to go to a Final Hearing for a judge to decide, the process can take much longer. Our aim is always to negotiate a settlement to avoid these delays.

Should I wait to apply for the Final Order?

Yes. It is almost always advisable to wait until your Financial Consent Order has been drafted by a solicitor and sealed by a judge before applying for your Final Order. Applying too early can have serious and unintended financial consequences, particularly regarding pensions.
