What is a Family Court Emergency?

An urgent or 'without notice' application is reserved for the most serious situations where a delay would cause significant harm to you or your child. Our solicitors can advise if your situation meets the legal test and act immediately.

Questions About Urgent Court Applications

What should I do first if I am in immediate danger?

If you or your child are at risk of immediate harm, your first call should always be to the police on 999. Once you are safe, you should then contact us for urgent legal advice on securing a protective court order.

What is a "without notice" hearing?

This is an emergency hearing that takes place without the other party (the Respondent) being notified. It is only granted in exceptional circumstances where alerting the other person could lead them to take the very action you are trying to prevent, such as absconding with a child.

What happens after an emergency order is made?

An order made at an emergency "without notice" hearing is temporary. The court will immediately schedule a second hearing, usually within a few days, where the other party is served with the papers and has the right to attend and respond to the order.
