Questions About Family Mediation

Is mediation legally binding?

No. The agreement reached in mediation, known as a 'Memorandum of Understanding', is not legally binding on its own. Your solicitor's crucial final step is to draft this agreement into a formal Financial Consent Order, which is then sealed by a judge to make it legally binding and enforceable.

Do I still need a solicitor if I am using a mediator?

Yes, it is essential. A mediator must remain impartial and cannot give either of you legal advice. Your solicitor is your independent advocate, advising you on your rights, what a fair settlement looks like, and ensuring the final agreement protects your interests.

What happens if we cannot agree on everything in mediation?

That is perfectly fine and very common. Mediation is still a success if it narrows down the issues in dispute. We can then use negotiation to resolve the remaining points, or if necessary, make a focused application to the court, having already saved significant time and cost.
