The Situation: An elderly man, 'P', had a significant estate but had lost the mental capacity to manage his affairs. He had not created an LPA while he was able to.

How much does an LPA cost?

What happens if I lose capacity without an LPA?

If you don't have an LPA, your family cannot automatically access your finances or make health decisions for you. They would need to make a slow and expensive application to the Court of Protection to have a 'Deputy' appointed. An LPA avoids this entirely, keeping you and your family in control.

How long does it take to register an LPA?

Once your LPA is signed, it must be registered with the Office of the Public Guardian (OPG) before it can be used. The OPG currently has a registration timescale of up to 20 weeks. This is why it is so important to plan ahead and not leave it until the last minute.
