Do I have to use the Probate Registry near me?

No. The probate service for England and Wales is now a national, centralised system. You do not need to visit a specific probate office in person. As your solicitors, we can handle the entire application for you from our offices, regardless of where you or the deceased lived.

What is the difference between a Grant of Probate and Letters of Administration?

They are both grants issued by the Probate Registry. A Grant of Probate is issued when there is a valid Will, confirming the authority of the Executors. A Grant of Letters of Administration is issued when there is no Will, confirming the authority of the Administrator (the next-of-kin).

Can I get a copy of a probate record from the registry?

Yes. Once a Grant has been issued, the Will (if one exists) and the Grant itself become public records. You can search for and order a copy of these documents online through the government's official probate records service. This is often necessary when finalising an estate.
