Real UK Case Study: The Cost of Having No LPA

The Case of 'P' [2016]

The Situation: An elderly man, 'P', had a significant estate but had lost the mental capacity to manage his affairs. He had not created an LPA while he was able to.

The Problem: His family members could not agree on how his finances should be managed. Because there was no LPA appointing a chosen Attorney, they had to make a costly and slow application to the Court of Protection to have a Deputy appointed.

The Outcome: The Court eventually appointed a professional Deputy to manage the estate, a decision that took control away from the family and incurred significant ongoing legal costs.

What this means for you: An LPA is the *only* way to choose who manages your affairs. Without one, the decision rests with a court, which is a more expensive, stressful, and time-consuming process for your family.

Your Questions About LPAs and Deputyship

How much does an LPA or Deputyship cost?

We offer a clear, fixed-fee service for creating and registering LPAs. An application to the Court of Protection for Deputyship is a more complex and therefore more costly process. In either case, we will provide you with a clear, written quotation for your approval before any work begins, so you have complete certainty on costs.

How long does the process take?

Once an LPA is signed, it must be registered with the Office of the Public Guardian (OPG), which can take up to 20 weeks. A Deputyship application is much slower and can take many months. This is why it is so important to plan ahead and create an LPA while you have capacity.

Why should I use a solicitor instead of a DIY service?

An LPA or Deputyship Order grants immense power to your attorneys or deputies. A solicitor ensures the document is drafted with precise, unambiguous language to prevent abuse and protect you from fraud. As SRA-regulated solicitors, we are fully insured and accountable for our advice, giving you a level of protection that unregulated services simply cannot offer.
