Questions About Family Court Applications

Do I have to attend mediation before I can apply to court?

For most applications involving children, you are required to attend a Mediation Information and Assessment Meeting (MIAM) first to see if the dispute can be resolved without court. There are exemptions, for example in cases of domestic abuse. We can advise if you need to attend.

What happens after the application is sent to the court?

Once the court issues (stamps) the application, it must be formally 'served' on the other person (the Respondent). The court will then set a date for the first hearing, known as the FHDRA in children's cases or the First Appointment in financial cases.

Can I represent myself in family court?

Yes, you are permitted to represent yourself. However, the family court process is complex, with strict rules and procedures. A simple mistake on an application form can cause significant delays and prejudice your case. Expert legal representation is a wise investment.
