Common Questions About Child Law

What is the first step if we can't agree?

Before you can apply to the court for most orders concerning a child, you are required to attend a Mediation Information and Assessment Meeting (MIAM). This is a short meeting with a trained mediator to see if the dispute could be resolved without going to court.

What is the 'Welfare Checklist'?

This is the list of seven factors that a judge must consider when making any decision about a child's upbringing. It includes the child's wishes and feelings, their physical and emotional needs, the likely effect of any change, and the capability of the parents to meet the child's needs.

How long does the family court process take?

The timeframe varies depending on the complexity of your case. If an agreement is reached, it can take a few months. If the case requires a final hearing to resolve contested issues, the full Family Court process can take from 6 to 12 months, or sometimes longer.
