Your Questions About Settlement Agreements

About Our 24-Hour Service

Who pays for the legal advice?

In almost all cases, your employer will pay a contribution towards your legal fees. This is because the law requires you to receive independent legal advice for the agreement to be valid. In many straightforward cases, this contribution will cover our entire fee, meaning there is **no cost to you**.

What documents do I need to send?

To give you the best advice, we need to see the Settlement Agreement itself and your contract of employment. If you don't have your contract, don't worry – we can still provide advice, but it's very helpful if you can find it.

Is the advice confidential?

Absolutely. Your discussion with us is protected by solicitor-client privilege, meaning it is completely confidential. We will not speak to your employer without your express permission.

About The Agreement

Do I have to accept the offer?

No, you are under no obligation to sign. Our role is to advise you on whether the offer is fair and reflects any potential claims you may have (such as unfair dismissal). If we believe the offer is too low, we can negotiate a better package on your behalf.

What happens if I sign the agreement?

Once signed, it becomes a legally binding contract. You waive your right to bring the legal claims listed in the agreement against your employer. In return, they are legally bound to pay you the agreed sum and provide any other terms, like a reference.

Is the settlement payment taxable?

The first £30,000 of a genuine compensation payment for loss of employment can usually be paid tax-free. However, any payments for notice, holiday, and other contractual entitlements are fully taxable. We will check the agreement is structured correctly and explain the tax position to you.

What does "without prejudice" mean?

This legal term means the conversations and documents related to the settlement negotiation are "off the record" and cannot be used as evidence in a future court case. This allows both parties to negotiate freely and openly to reach an agreement.

Get a Fair Deal. Protect Your Future.

Don't sign anything under pressure without expert legal advice. Our specialist solicitors are here to ensure your settlement agreement is fair and your rights are fully protected.
