What are the time limits for an appeal?

The time limits are extremely strict. You must file your Appellant's Notice within **21 days** of the date the decision was made. Given the short timeframe, it is absolutely vital to seek specialist legal advice immediately after you receive the judgment.

Is an appeal a re-hearing of my case?

No. This is a crucial point. An appeal is not a second chance to present your original evidence. The appeal judge will not re-hear the witnesses. Their job is to review the original decision and decide if the first judge made a serious legal or procedural error.

What are the risks if I lose my appeal?

Appeals are high-risk. If your appeal is unsuccessful, the original order will stand. Crucially, you will likely be ordered to pay the other party's legal costs for having to respond to your unsuccessful appeal, which can be very substantial.
