What Are the Grounds for an Appeal?

Crucially, you cannot appeal a decision just because you disagree with it. An appeal is not a re-hearing of your case. You must be able to prove to a more senior judge that the original decision was legally wrong or unjust because of a serious mistake.

The Judge Made a Mistake in Law

This is where we argue that the judge misinterpreted or incorrectly applied the relevant family law statutes or case law when making their decision.

The Judge Made a Mistake on the Facts

This involves proving that the judge's conclusion was based on a misunderstanding of the evidence or that the decision they reached was one that no reasonable judge could have made based on the facts presented.

A Serious Procedural Irregularity

Here, we argue that the process of the hearing was so flawed or unfair that it prevented justice from being done, for example, if you were not allowed to present a key part of your evidence.

Questions About Family Court Appeals

What are the time limits for an appeal?

The time limits are extremely strict. You must file your Appellant's Notice within **21 days** of the date the decision was made. Given the short timeframe, it is absolutely vital to seek specialist legal advice immediately after you receive the judgment.

Is an appeal a re-hearing of my case?

No. This is a crucial point. An appeal is not a second chance to present your original evidence. The appeal judge will not re-hear the witnesses. Their job is to review the original decision and decide if the first judge made a serious legal or procedural error.

What are the risks if I lose my appeal?

Appeals are high-risk. If your appeal is unsuccessful, the original order will stand. Crucially, you will likely be ordered to pay the other party's legal costs for having to respond to your unsuccessful appeal, which can be very substantial. This is why a frank assessment of your chances is the essential first step.
