Arrangements for Babies & Very Young Children

The Family Court places special emphasis on the needs of infants and toddlers. The key priority is ensuring stability, routine, and the ability for the baby to form strong bonds with both parents. We help you create a practical and child-focused plan.

Key Considerations for Baby Custody:

  • The Primary Carer: The court will look at who has been the baby's main caregiver to date to ensure continuity.
  • Feeding & Routine: Practical matters like breastfeeding schedules are highly important in determining contact arrangements.
  • Overnight Stays: It is common for contact with the non-resident parent to be shorter and more frequent, building up to overnight stays as the child gets older.
  • Parental Responsibility: We can help fathers who are not on the birth certificate secure their legal parental rights.

Common Questions About Baby Custody

Who gets custody of a baby if parents are not married?

The mother automatically has Parental Responsibility. The father has it too if he is named on the birth certificate. The court does not favour one parent over the other and will make a decision based purely on what is best for the baby's welfare, focusing on who has been the primary carer.

At what age can a baby stay overnight with the other parent?

There is no set age, as every child is different. The court will consider the baby's feeding schedule (especially breastfeeding), routine, and the strength of the bond with both parents. Contact is often built up gradually, starting with shorter, frequent visits before moving to overnight stays.

What if my ex-partner is preventing me from seeing my baby?

Unless there is a safeguarding risk, the court strongly believes a baby should have a relationship with both parents. If you are being unreasonably prevented from seeing your baby, a solicitor can help you negotiate or apply for a Child Arrangement Order to formalise contact.
