Protecting Your Finances After Divorce

Can an Ex-Partner Claim My Pension After Divorce?

The answer is yes - unless you have a legally binding Financial Consent Order. Our expert family solicitors can help you secure a Clean Break Order to protect your pension, property, and future assets, even years after your divorce was finalised.

The Critical Difference: Divorce vs. Financial Separation

Many people believe that once their Decree Absolute or Final Order is granted, all legal ties are severed. This is a dangerous misconception. The divorce process and the financial settlement are two separate legal procedures.

The Risk of Divorce Alone:

  • Your Final Order (Decree Absolute) only dissolves your marriage.
  • It does **not** end the financial claims you and your ex-spouse have against each other.
  • These claims remain 'live' indefinitely, regardless of how many years have passed.
  • Your ex-partner could make a future claim on your pension, property, savings, or even an inheritance.

The Solution: A Financial Consent Order

  • This is a separate legal document, drafted by a solicitor and approved by a judge.
  • It makes your financial agreement legally binding and enforceable.
  • Crucially, it includes a 'Clean Break' clause that legally dismisses all future claims.
  • This is the **only** way to permanently protect your pension and other assets.

Questions About Post-Divorce Financial Claims

Is it too late to get a Financial Order if I'm already divorced?

No, it is not too late. You can apply for a Financial Consent Order at any time after your Conditional Order has been granted, even years after your Final Order (Decree Absolute). It is highly advisable to do so to protect yourself from future claims.

What if my ex-partner won't agree to a Clean Break Order now?

If your ex-partner will not cooperate, you can apply to the court for a contested Financial Order. The court will then direct the process, and a judge will ultimately make a final, legally binding decision on the division of your assets.

My ex has remarried. Can they still claim against me?

If your ex-partner has remarried, they generally lose the right to claim spousal maintenance from you. However, this does **not** automatically stop them from being able to make a claim against your assets, such as your pension or property. Only a court order with a clean break clause can do that.
