Questions About the Final Stage of Divorce

What is the difference between a Decree Absolute and a Final Order?

There is no legal difference; it is simply a name change. Following the introduction of 'no-fault divorce' in April 2022, the 'Decree Nisi' was renamed the 'Conditional Order', and the 'Decree Absolute' was renamed the 'Final Order'. They do the same thing: legally end the marriage.

Why shouldn't I apply for my Final Order straight away?

Once the Final Order is granted, you are no longer spouses. This can have serious financial consequences, particularly concerning pension rights or inheritance if one party were to pass away. It is almost always advisable to wait until your Financial Consent Order is approved by a judge before applying for the Final Order.

What happens if I get divorced without a Financial Order?

You leave yourself financially vulnerable for the rest of your life. Without a Clean Break Order (which is part of a Financial Order), your ex-spouse's financial claims are not dismissed. This means they could potentially make a claim against your future earnings, property, or inheritance, even many years after you have separated.
