Common Child Custody Questions

Can I get "full custody" of my child in the UK?

The court can grant a 'live with' order to one parent, which is what most people mean by sole custody. However, this is only awarded if it's proven to be in the child's best interests. The court's usual starting point is that a child benefits from a relationship with both parents.

What are my parental rights if I am not married?

Mothers automatically have Parental Responsibility. Fathers have it automatically if they were married to the mother or are named on the birth certificate (after December 2003). We can help you secure your parental rights if you don't have them automatically.

Do I have to go to court to sort out custody?
