When Does the Court Grant Sole Custody?

The court's only priority is the child's welfare. While the starting point is that a child benefits from a relationship with both parents, a 'live with' order to one parent (sole custody) will be made if it is necessary to protect the child from a risk of harm. This requires strong, clear evidence.

Domestic Abuse or Harm

If there is evidence of domestic abuse, neglect, or emotional harm, the court will act decisively to protect the child. We are experts in representing parents in these difficult cases.

Common Questions About Sole Child Custody

What is the difference between sole and joint custody?

In UK law, "sole custody" means a 'live with' order is made for one parent, making them the primary carer. "Joint custody" usually means a 'shared live with' order where the child splits their time between both parents' homes, though not always on a 50/50 basis.

If I have a sole 'live with' order, can the other parent still see our child?

Yes, almost always. Unless there is a very serious risk of harm, the court will still make an order for the child to spend time and have contact with the other parent. This could be supervised contact if there are safety concerns.

What evidence do I need to get sole custody?

You need strong evidence to show why a shared care arrangement is not in your child's best interests. This can include police reports, medical records, school reports, evidence from social services, or witness statements from people who have seen the other parent's behaviour.
