Questions About Cohabitation Agreements

Isn't a "common law marriage" legally recognised in the UK?

No. This is a very common but dangerous myth. There is no such thing as a "common law marriage" in the UK. Unmarried couples have very few of the legal rights that married couples or civil partners do, which is why a Cohabitation Agreement is so important.

Is a Cohabitation Agreement legally binding?

If drafted correctly by a solicitor, where both parties have had the opportunity to take independent legal advice and have provided full financial disclosure, a Cohabitation Agreement will be a legally binding contract that is highly likely to be upheld by a court.

What happens to our agreement if we get married later on?

A Cohabitation Agreement automatically ceases to have effect if you later marry or enter into a civil partnership. If you still want to have a formal agreement about your finances, you would need to create a Prenuptial Agreement before the marriage.
