What is the difference between a Witness Statement and a Position Statement?

A Witness Statement is your main, detailed evidence, setting out the full history of your case. A Position Statement is a much shorter, summary document, usually prepared for a specific court hearing to quickly update the judge on the key issues and what you are asking for.

How long should a Position Statement be?

This is critical. A Position Statement should be very brief, typically no more than two pages. The court has very limited time to read documents before a hearing, so a concise, focused statement is much more powerful and effective than a long one.

What are the most important things to include?

You should include a brief background, an update on what has happened since the last hearing, the key issues you believe the judge needs to decide, and a clear list of what you are asking the court to order at this specific hearing.
