Which Type of Restraining Order Do You Need?

In UK family law, there are two main types of court injunctions, commonly known as 'restraining orders'. They offer powerful and immediate protection, and a breach of the most common type is a criminal offence.

Non-Molestation Order

This is the main type of restraining order. It prohibits a partner or ex-partner from harassing, intimidating, or being violent towards you and your children.

  • Stops unwanted calls, texts, and social media contact.
  • Prevents the person from coming near your home or workplace.
  • A breach is a criminal offence, and the police can make an arrest.

Occupation Order

This order regulates who can live in the family home. It is a powerful tool to ensure your safety and stability.

  • Can exclude an abuser from the property, even if they are the owner.
  • Can allow you to return to the home if you have been forced out.
  • Sets out who pays the rent or mortgage in the short term.

Common Questions About Family Law Injunctions

How quickly can I get an injunction?

In cases of immediate risk or significant harm, we can apply for an emergency "without notice" order. This means a hearing can be listed within 24-48 hours. The court will then schedule a further hearing where the other party can attend and respond.

What happens if an injunction is breached?

This is very serious. If a Non-Molestation Order is breached, it is a criminal offence and the police can make an arrest. Breaching other orders, such as an Occupation Order, can lead to committal to prison or fines for contempt of court.

How long does an injunction last?

Non-Molestation Orders are typically made for a fixed period, usually 6 to 12 months, but they can be extended if necessary. Occupation Orders are often made for shorter periods, also usually 6 to 12 months, to resolve an immediate crisis before long-term arrangements are made.
