What is a Financial Consent Order?

A Financial Consent Order is a legally binding document, approved by a judge, that sets out the financial agreement you have reached with your ex-spouse. It is essential for preventing future claims and making the agreement enforceable. A solicitor is required to draft this for you.

What happens if we can't agree on a financial settlement?

If you cannot agree through negotiation or mediation, one of you will need to make an application to the court for a Financial Order. The court will then follow a formal process, and a judge will ultimately decide on a fair division of your matrimonial assets for you.

Do I have to be divorced to get a Financial Order?

You can start negotiating your financial settlement at any time. However, a Financial Consent Order can only be submitted to the court for approval after you have received your Conditional Order (the middle stage of the divorce process). The order then becomes legally binding once you receive your Final Order.
