Building Your Case to Bring Your Child Home

A temporary or 'interim' custody order is made when the court has concerns about a child's welfare. To get your child back, you must prove to the judge that any concerns have been fully addressed and that it is now in your child's best interests to return to your care. Our role is to help you do exactly that.

Addressing the Court's Concerns

The first step is to understand exactly why the temporary order was made. We meticulously review the court's judgment and help you create a clear action plan to address every single concern raised.

Gathering Positive Evidence

We help you build a powerful portfolio of positive evidence to show your progress. This can include reports from support services, proof of stable housing, and positive feedback from school or health visitors.

Build Your Evidence

Applying to Vary the Order

When the evidence is ready, we make a formal application to the court to vary the existing order and ask for your child to be returned to your full-time care. We will represent you robustly at the hearing.

Questions About Getting Your Child Back

Why did the court make a temporary order in the first place?

A judge will only make an Interim Care Order (to social services) or an interim 'live with' order (to the other parent) if they have heard evidence that suggests a child may be at risk of harm in their current situation. The order is temporary to allow time for a full investigation.

Will the court hold my past mistakes against me?

The court's main concern is your child's welfare *now* and in the future. While past events are relevant, the judge will be most interested in the positive changes you have made and the evidence you can provide to show you are now able to provide safe and stable care for your child.

What is the most important evidence I need?

Evidence that directly addresses the court's original concerns is most powerful. This could be a certificate from a completed course (like anger management or a parenting class), clean drug and alcohol test results, or a report from a support worker confirming your positive progress.
