Why Choose Legal Separation (Judicial Separation)?

A formal Judicial Separation is a powerful tool for couples who need to separate their lives but do not wish to divorce, often for religious, personal, or financial reasons. It allows the court to make legally binding orders about your finances and children, providing crucial clarity and protection.

A Legal Separation Can:

  • Allow you to live separate lives without legally ending the marriage.
  • Result in legally binding orders for the division of property, assets, and maintenance.
  • Formalise child arrangements and secure child support.
  • Provide legal protection if you have been married for less than one year.
  • Be a sensible first step if you are not yet certain you want to divorce.

What a Legal Separation Does Not Do

It is crucial to understand that a Judicial Separation does not end your marriage. You will remain legally married to your spouse and will not be free to remarry in the future until you have obtained a formal divorce.

Questions About Legal Separation

What is the difference between Legal Separation and a Separation Agreement?

A Legal Separation (Judicial Separation) is a formal court process that results in legally binding court orders for your finances and children. A Separation Agreement is a written contract that is not automatically binding but has significant weight. A Legal Separation provides a much higher level of legal certainty and enforceability.

Can the court make the same financial orders as in a divorce?

Almost. The court can make all the same orders regarding the division of property, assets, and maintenance as it can in a divorce. The only major order it cannot make during a Judicial Separation is a Pension Sharing Order.

If we get a Legal Separation, can we still get divorced later?

Yes. If you decide later that you wish to formally end the marriage, you can still apply for a divorce. The financial orders made during your Legal Separation can often be used as the basis for the final order in your divorce, making the process more straightforward.
