Understanding the Cost of a Deputyship Application

The total cost of becoming a Deputy is made up of several parts. We believe in complete transparency and will provide a clear breakdown of all expected costs from the very beginning.

1. Court Application Fee

The Court of Protection charges a mandatory, fixed application fee when the papers are submitted. This is a standard disbursement paid to the court.

2. Solicitor's Legal Fees

These are our professional fees for the extensive legal work involved, including preparing all complex court forms, gathering evidence, and managing the application on your behalf.

3. Other Potential Costs

Other costs can include a fee for a medical professional to complete the mental capacity assessment (COP3 form) and the annual fee for a Deputy's security bond.

Important: All Costs are Paid from the Person's Funds

You do not need to pay for the deputyship application from your own money. Once the order is granted, all authorised legal fees and court costs are reimbursed from the funds of the person you are helping.

Your Questions About Deputyship Costs

Are there any ongoing costs after being appointed?

Yes. Once you are appointed as a Deputy, you must pay an annual supervision fee to the Office of the Public Guardian (OPG). You will also need to pay for a security bond, which is an insurance policy that protects the person's assets. All of these ongoing costs are payable from the funds of the person you are acting for.

Can I get help with the court application fee?

Yes, you may be eligible for a fee remission (a reduction or waiver) for the court application fee if the person you are applying for has a low income and limited savings. We can assess your eligibility and help you apply for this as part of our service.

Is a Deputyship more expensive than an LPA?

Yes, significantly. The court application for a Deputyship Order is a much more complex, lengthy, and therefore more expensive process than creating and registering a Lasting Power of Attorney (LPA). This is why our solicitors always stress the importance of creating an LPA in advance, as it is the most cost-effective way to plan for the future.
