Your Development & Land Acquisition Questions Answered

Acquiring Land

What is the difference between an Option and a Conditional Contract?

An Option Agreement gives you the *right* to buy the land within a set period, usually after you have secured planning permission. A Conditional Contract creates a binding *obligation* to buy the land if certain conditions, such as planning consent, are met.

What is 'site assembly'?

Site assembly is the process of acquiring several adjoining parcels of land from different owners to create a single, larger development site. This is a legally complex process that our real estate solicitors are highly experienced in managing.

What due diligence is required for land?

It is extensive. We investigate the legal title, restrictive covenants, access rights, environmental reports, and conduct all necessary searches to ensure the land is suitable for your proposed development before you are legally committed.

Developing & Selling

What is a Section 106 Agreement?

A Section 106 Agreement is a legal agreement between a developer and a local planning authority, often required to grant planning permission. It typically outlines obligations such as providing affordable housing or funding local infrastructure.

How do you set up plot sales for a new estate?

We prepare a master legal pack for the entire site at the outset. This includes the draft contract, transfer deed (TP1), and all relevant planning documents. This standardisation allows us to handle the sale of individual new build plots with maximum speed and efficiency.

Do I need to create a management company?

If the new development includes shared areas or services (e.g., private roads, communal gardens in an apartment block), a management company will need to be set up to maintain these areas. Our corporate solicitors can establish this for you.
