The Remortgage Process

Why do I need a solicitor to remortgage?

You need a solicitor to handle the legal work for both your new and old mortgage lenders. We redeem your old mortgage, carry out legal checks for the new lender, and register their new legal charge against your property at the Land Registry.

How long does a remortgage take?

A straightforward residential remortgage can often be completed in as little as 2-4 weeks. Commercial property remortgages may take slightly longer. We will always work proactively to complete as quickly as possible.

Can I remortgage to buy out an ex-partner?

Yes, this is very common and is known as a Transfer of Equity. We handle the remortgage and the legal transfer of ownership simultaneously, removing your ex-partner's name from the deeds and mortgage.

Financial & Legal Considerations

What are early repayment charges (ERCs)?

An ERC is a penalty fee charged by your existing lender if you repay your mortgage during the initial fixed-rate period. It's crucial to check for any ERCs before you decide to remortgage. We will review your original mortgage offer for this.

Do I need new property searches to remortgage?

It depends on your new lender's requirements. Some lenders are happy with indemnity insurance, while others may insist on new searches. We will advise you on the most cost-effective and efficient route based on your specific circumstances.

What if I'm remortgaging a leasehold property?

For a leasehold property, we will also need to serve notice of the new mortgage on your freeholder or the management company and ensure all ground rent and service charges are up to date, as required by your new lender.
