What are My Parental Rights After a Divorce?

The key legal concept is 'Parental Responsibility', which is defined as all the rights, duties, and authority a parent has for a child. Divorce does not remove Parental Responsibility from either parent. Our role is to help you formalise how those rights and responsibilities will be shared.

Securing Parental Responsibility

If you are an unmarried father not named on the birth certificate, we can help you acquire Parental Responsibility, either by agreement or through a court order, giving you a legal say in your child's life.

Child Arrangement Orders

This is the primary way to define your parental rights. A Child Arrangement Order sets out who the child lives with and the time they spend with the other parent.

Specific Issue & Prohibited Steps

We can help you apply for specific orders to exercise your parental rights regarding key decisions like schooling, medical treatment, or preventing your child from being moved or taken abroad without your consent.

Questions About Parental Rights After Divorce

Does the mother automatically get custody in a divorce?

No. This is a common myth. The law does not favour mothers over fathers. The court's only consideration is what is in the child's best interests, and it will make an order based on the specific facts of your case. Both parents start on an equal footing.

What does Parental Responsibility mean?

Parental Responsibility (PR) is the legal term for all the rights and duties you have as a parent. This includes providing a home for the child and making important decisions about their education, religion, and medical treatment. If you have PR, you have a right to be consulted on these key decisions.

Can my ex-partner stop me from seeing my children?

No, not without a court order. Unless there is a genuine safeguarding risk to the child, one parent cannot unilaterally stop the other parent from having contact. If this is happening, you can apply to the court for a Child Arrangement Order to enforce your rights.
