Compromise Agreement FAQs

What's the difference between a Compromise and a Settlement Agreement?

There is no legal difference. 'Compromise Agreement' was the official term for this type of document until 2013, when the name was officially changed to 'Settlement Agreement'. Many employers and people still use the old name, but they refer to the same legally binding document.

Do I really have to get legal advice?

Yes. For a compromise (or settlement) agreement to be legally valid and binding, the law states that the employee must receive advice from a qualified, independent legal adviser who signs an Adviser's Certificate. Without this, you could still bring a claim against the employer in the future.

Can I ask for more money than is offered?

Yes, potentially. If we assess the offer and believe it is too low (for example, if you have a strong case for unfair dismissal), we can negotiate with your employer on your behalf to increase the settlement amount. Our fee, paid by the employer, often includes a provision for this negotiation.
