Your Rights Under the Equality Act 2010

The law defines a disability as a 'physical or mental impairment' that has a 'substantial and long-term' negative effect on your ability to do normal daily activities. This is a broad definition and can include conditions like depression, anxiety, dyslexia, and long-term illnesses. We are experts in all forms of employment discrimination and can advise on your specific situation.

The law is complex and covers many situations. If you feel you've been treated unfairly but don't see your exact issue listed, please contact us. Your experience may still be unlawful.

Disability Discrimination FAQs

Do I have to disclose my disability to my employer?

Generally, you are not required to disclose a disability. However, for an employer to be under the duty to make reasonable adjustments, they must know (or ought reasonably to know) that you have a disability. We can provide strategic advice on how and when to disclose a condition to ensure you are protected.

What counts as a "reasonable adjustment"?

This is any change to your role or workplace that removes a disadvantage caused by your disability. Examples include providing special equipment, allowing flexible working hours, changing your duties, or providing a phased return to work after sickness absence. What is 'reasonable' depends on the specific circumstances and the employer's resources.

Can I be dismissed for being off sick with a disability?

It can be unlawful disability discrimination to dismiss you for sickness absence that is related to your disability. An employer must first make reasonable adjustments and follow a fair capability process. A dismissal in these circumstances could lead to a strong claim at an Employment Tribunal.

You Don't Have to Face This Alone

Unfair treatment because of your health is unlawful. Our expert discrimination solicitors are here to provide the confidential advice and robust representation you need.
