The Path to a Child Arrangement Order

Understanding the legal process can provide peace of mind. While every case is unique, our solicitors guide you through each stage, always aiming for an amicable agreement but ready to robustly represent you in court if needed.

1

Initial Advice & Strategy

We discuss your situation in confidence, explain your options, and help you establish clear, child-focused objectives for the future.

2

Mediation (MIAM)

Before applying to court, you will usually be required to attend a Mediation Information and Assessment Meeting (MIAM) to see if the dispute can be resolved without court action.

3

Court Application (C100)

If agreement isn't possible, we will prepare and submit a comprehensive C100 application form to the Family Court on your behalf, detailing the order you are seeking.

4

First Hearing (FHDRA)

We will represent you at the First Hearing Dispute Resolution Appointment, where the court identifies the key issues and decides on the next steps.

Common Child Arrangement Questions

How long does a Child Arrangement Order take?

The timeframe can vary significantly depending on the complexity of your case and whether you can reach an agreement. If an agreement is reached quickly, it can take a few months. If the case needs to go to a final court hearing, it can take between 6 and 12 months, sometimes longer.

Do I have to go to court to arrange child contact?

No, you do not have to go to court. We always encourage parents to reach an agreement through negotiation or mediation. A court application is a last resort. If you do agree, we can help you make it legally binding with a 'Consent Order' to provide future security.

What if my ex-partner is preventing me from seeing my child?

Unless there is a risk of harm to the child, the court's starting position is that a child has a right to a relationship with both parents. If you are being unreasonably prevented from seeing your child, we can advise on your options, from negotiation to applying for an urgent Child Arrangement Order.
