Do grandparents have automatic legal rights?

In the UK, grandparents do not have automatic rights. However, the law gives you the right to apply to the court for permission (leave) to seek an order for contact or for the child to live with you, recognising the vital importance of your relationship.

When might a grandparent be granted custody?

A court may grant a 'live with' order or a Special Guardianship Order to a grandparent if it is in the child's best interests. This is common in tragic circumstances where parents have passed away, or in difficult situations where parents are unable to provide safe and stable care for their children.

What is a Special Guardianship Order (SGO)?

An SGO is a more powerful, long-term order than a 'live with' order. It grants the Special Guardian (e.g., the grandparent) enhanced and overriding Parental Responsibility. This means you can make key decisions about the child's upbringing, such as schooling or medical treatment, without needing to consult the parents.
