What is a Separation Agreement?

A Separation Agreement is a written contract between a separating couple. It sets out your agreed arrangements for finances, property, and children, providing clarity and a blueprint for your future. It can be used by both married and unmarried couples.

What a Separation Agreement Can Cover:

  • Who will remain in the family home and who will pay the bills.
  • How joint savings, investments, and debts will be divided.
  • Arrangements for child contact and child maintenance.
  • The division of personal belongings like cars and furniture.
  • How you will formally begin the divorce or dissolution process later on.

Is it Legally Binding?

While not automatically enforceable by a court in the same way as a court order, a well-drafted Separation Agreement is a formal contract. A judge will give it significant weight and is highly likely to uphold its terms, provided it was entered into fairly by both parties.

Questions About Separation Agreements

Why not just get a court order straight away?

A Separation Agreement is an excellent first step if you are not yet ready to start formal divorce proceedings. It provides immediate clarity and can be used as the basis for a legally binding Consent Order once the divorce process begins.

Do we both need to get independent legal advice?

For a Separation Agreement to have the most legal weight, it is highly advisable that both parties receive independent legal advice on its terms. This ensures that neither party can later claim they were pressured or did not understand what they were signing.

What happens if my partner doesn't stick to the agreement?

Because it is a legal contract, you can potentially sue for breach of contract. More commonly, the agreement would be used as very strong evidence in an application to the court for a Financial Consent Order, and a judge would be highly likely to uphold its terms.
