Our 4-Step Transfer Process

1

Lease & Title Review

We start by meticulously reviewing your existing lease to confirm the transfer requirements, known as 'alienation' clauses.

2

Application for Consent

We formally apply to the landlord or managing agent for the 'Licence to Assign', providing all necessary references and documentation.

3

Drafting the Legal Pack

We draft the Deed of Assignment (for commercial) or TR1 Form (for residential) and negotiate any required Authorised Guarantee Agreement (AGA).

4

Completion & Registration

We manage the completion of the transfer and register the new owner's details with the Land Registry, finalising the process.

Your Lease Transfer Questions Answered

For Residential Leaseholders

Can my landlord refuse to let me sell my flat?

A landlord cannot unreasonably withhold consent for a lease transfer (sale), but they can refuse if the buyer does not meet the criteria set out in the lease. We manage this consent process to ensure it is handled smoothly.

What is an LPE1 Form (Leasehold Property Enquiries)?

The LPE1 is a standard form used to collect essential information from the landlord or managing agent about the property, including service charges, ground rent, and any planned major works. It is a critical part of the buyer's due diligence.

Who pays the landlord's fees for the transfer?

Typically, the seller (the outgoing leaseholder) is responsible for paying the landlord's administrative and legal fees for processing the application and providing the LPE1 information.

How long does a lease transfer take?

A residential lease transfer usually takes longer than a freehold sale, often between 12 to 20 weeks. This is because it is dependent on the speed of the landlord or managing agent in providing the necessary information and consent.

For Commercial Tenants & Landlords

What is a 'Licence to Assign'?

A Licence to Assign is the formal legal document from the landlord that grants the tenant permission to transfer (assign) the lease to a new tenant. It will contain conditions that all parties must adhere to.

What is an 'Authorised Guarantee Agreement' (AGA)?

An AGA is a document that a landlord may require the outgoing tenant to sign. It means that if the *new* tenant fails to pay the rent or breaches the lease, the landlord can pursue the *original* tenant. Negotiating this is a key part of our service.

On what grounds can a landlord refuse consent to assign?

A landlord can usually only refuse consent on reasonable grounds. This typically relates to the financial standing of the proposed new tenant or their ability to comply with the lease covenants. We can advise on whether a landlord's refusal is reasonable.

Can I sublet part of my commercial property?

This depends entirely on the terms of your lease. Most leases will permit subletting of part of the property, but only with the landlord's formal consent and subject to strict conditions. We can review your lease and advise on the correct procedure.
