Understanding the Occupier's Consent Form

Also known as an "Occupier's Waiver" or "Deed of Consent," this form is required by mortgage lenders to protect their security. By signing it, you are making a serious legal declaration.

  • What you are agreeing to: You agree to give the mortgage lender's rights priority over your own right to live in the property.
  • What this means: If the property owner fails to pay the mortgage, the lender can repossess and sell the property, and you will be required to leave, even if you are not the owner.
  • Why you need a solicitor: The lender needs to be certain that you have received Independent Legal Advice (ILA) and were not pressured into signing. A solicitor's signature provides this proof.

Our Simple & Efficient Process

1. Book Your Appointment

Use our form to request a callback. We will provide a fixed-fee quote and arrange a convenient time for a video call or in-person meeting.

2. The ILA Meeting

In a private meeting, our solicitor will explain the form to you in plain English, ensure you understand the risks, and confirm you are signing freely.

3. Sign & Certify

Once we are satisfied you understand, we will witness your signature and complete the solicitor's certificate, which we then send on to the lender's solicitors.

Your Questions Answered

Why do I need a different solicitor to the property owner?

The entire purpose of the form is to ensure you have received **Independent** Legal Advice. To be truly independent, the advice must come from a solicitor who has no connection to the property owner or the transaction. This protects both you and the lender.

What happens if I refuse to sign the form?

If you do not sign the Occupier's Consent Form, the mortgage lender will almost certainly refuse to provide the loan, and the transaction will not be able to proceed. Our role is not to force you to sign, but to ensure you fully understand what you are signing.
