Eligibility & The Application

Am I eligible for the Right to Buy scheme?

To be eligible, you must have been a public sector tenant (with a council, housing association, or NHS trust) for a total of 3 years. The property must be your main and only home. Certain properties, like housing for the elderly, may be exempt.

How big is the Right to Buy discount?

The maximum discount varies for houses and flats and is higher in London. The amount you get depends on how long you have been a public sector tenant. We can help you check you are being offered the correct discount in your S125 offer notice.

What happens if my landlord delays the process?

Your landlord must adhere to strict deadlines. If they cause unreasonable delays, you may be entitled to have rent payments deducted from the final purchase price. We can advise on serving delay notices if this becomes an issue.

The Purchase Process

Can I get a mortgage for a Right to Buy purchase?

Yes. Many high street lenders offer specific Right to Buy mortgages. Some will even lend based on the discounted price, meaning you may not need to provide a large deposit. You should speak to a mortgage advisor to explore your options.

What happens if I want to sell the property later?

If you sell within the first 5 years of buying, you will have to repay some or all of the discount you received. Additionally, for 10 years, you must offer the property back to your old landlord or another social landlord first before you can sell it on the open market.

Will I have to pay service charges after I buy my flat?

Yes. If you buy a leasehold flat, you will become a leaseholder and will have to pay an annual service charge to the council or housing association for the upkeep of the building and communal areas. Your landlord's offer notice (S125) must provide an estimate of these costs.
