Employment Contract FAQs

What counts as a 'breach of contract'?

A breach occurs when one party fails to fulfill a key term of the contract. For an employer, this could be not paying the agreed salary or changing your job role without consent. For an employee, it could be leaving without working their notice period or breaching a confidentiality clause.

My employer changed my contract, can they do this? (For Employees)

An employer cannot lawfully change a fundamental term of your contract without your agreement. If they impose a change (like cutting your pay or changing your hours) and you do not accept it, you may have a claim for breach of contract or even constructive dismissal. It is vital to seek advice before taking any action.

Is a restrictive covenant in a contract enforceable? (For Employers)

It can be, but only if it is drafted carefully to be no wider than is reasonably necessary to protect a legitimate business interest (like your client relationships or trade secrets). A generic, overly broad clause will likely be struck down by a court. We can draft and advise on enforceable restrictive covenants.
