What is the difference between the Family Court and the Family Division?

The Family Court deals with the vast majority of family cases. The Family Division is part of the High Court and is reserved for a small number of cases that are unusually complex, involve substantial assets, or have an international element. Cases can be started in or transferred to the Family Division by a judge.

Do the same rules apply in the Family Division?

Yes, the Family Procedure Rules 2010 apply to all family courts. However, the interpretation and application of these rules are often more formal and rigorous in the High Court. The judge's expectations regarding evidence, documentation, and conduct are extremely high.

Can I appeal a decision to the Family Division?

Yes. If a final decision has been made by a lower-level judge (a Lay Magistrate or District Judge) in the Family Court, you can apply for permission to appeal the decision to a Circuit Judge or a High Court Judge of the Family Division.
