Questions About Writing a Court Statement

Why can't I just write my own statement?

You can, but it is risky. A poorly written statement can harm your case. Solicitors are trained to use objective, non-inflammatory language and to structure the facts in a way that is persuasive to a judge. We know what to include, and just as importantly, what to leave out.

What is the difference between a Witness Statement and a Position Statement?

A Witness Statement is your main evidence, containing all the detailed factual background of the case. A Position Statement is a much shorter, summary document, usually prepared for a specific hearing to update the judge on the key issues.

What are the most important things to include?

The most important things are facts, dates, and specific examples. Your statement should be a clear, chronological account of events, directly addressing the issues the court is being asked to decide upon and referencing your supporting evidence.

What should I absolutely NOT include in my statement?

You should avoid including opinions, emotional language, hearsay (what other people have told you), and irrelevant personal attacks. These things weaken your credibility and can frustrate the judge. Our job is to ensure your statement remains focused and professional.
